The Delta AI Performance Guarantee

Guaranteed to book more appointments than a human setter, or we refund the install.

Measured in your first 30 days against the same 30 days before we installed, on the channels you bought and on your own leads. It covers Messages on its own, Phone on its own, and Messages + Phone together, each measured against that channel's own baseline.

Requires a minimum of 100 qualified inbound leads per month routed into the system through the channels you bought, those channels left connected to the system for the whole 30 days, and a 30 day tuning window, plus the rest of the conditions in the full terms.

This page is the whole promise. If a condition is not written below, it is not a condition. If something below does not match what you were told on a call, the written version here is the one that counts, so raise it with us before you sign.

The conditions, in short

The conditions, in full

The lead volume minimum

The guarantee applies when at least 100 qualified inbound leads per month are routed into the system through the channels you bought. If you bought Phone on its own, that means 100 qualified inbound calls. If you bought Messages on its own, 100 qualified inbound messages. If you bought both, the two together.

A qualified inbound lead is a real person, in your service area, who contacted you or opted in through one of the channels you bought, and who has a reachable phone number or email address. Purchased cold lists, duplicates, spam submissions, test entries, and contacts outside your service area do not count toward the minimum.

If fewer than 100 qualified leads reach the system in the 30 day window, the guarantee does not trigger. We will tell you the running count inside your dashboard so this is never a surprise at the end.

The baseline we measure against

The baseline is the number of appointments your setter or your team booked from your inbound leads in the 30 days before install, on the same channels you bought. That is the number the agent has to beat.

The channels have to match on both sides. A Phone install is measured against what your phone booked before, a Messages install against what your messaging booked before, and Messages + Phone against both together. We do not hold a single channel to a whole-business number that includes work you did not buy.

If you do not have that number, we measure one before we start. We run a 7 day lead-response audit on your live inbound leads before the install begins, on those same channels, count what your current process booked from them, and use that as the baseline.

What that audit booked is scaled to a 30 day equivalent before we compare anything, so the agent is never measured against a shorter stretch of your business than it gets itself.

Either way, the baseline goes in writing and we both sign off on it before go-live. A baseline we did not agree in writing before go-live is not a baseline we get to argue about on day 31.

What counts as a booked appointment

A booked appointment is a contact who accepts a specific date and time that is written to your connected calendar. Counted once per contact.

The comparison runs on inbound leads on both sides, on the channels you bought. The baseline is what your setter or your team booked from those leads. The agent's number is what it booked from those leads. Whoever did the booking, the same rule decides whether it counts.

Counted on both sides:

  • • Appointments the contact later cancels or reschedules on their own.
  • • No-shows. Whoever books the appointment, whether the person turns up is outside anyone's control.

Counted on neither side:

  • • Appointments booked out of your existing contact list. The agent works your dead list and those bookings are yours to keep, but they stay outside the comparison, because your baseline month has nothing to match them against.
  • • Appointments you cancel, or that could not be booked because the calendar had no open slot.
  • • Duplicate, test, spam, or internal contacts.

When the 30 days start and end

The clock starts on go-live day, meaning the first day the system handles live traffic on your channels. It does not start on the day you pay, and it does not start during the 7 day install or testing.

The window is 30 consecutive calendar days from go-live. Days where you pause, disconnect, or switch off the system do not count toward the 30 and extend the window by the same number of days.

Either way the comparison is 30 days of live operation against the 30 day baseline. Extending the calendar does not add measured days, and it does not change how we settle it: we count the appointments on each side.

The channels you bought stay connected

The channels you bought stay connected to the system for the whole 30 days. If you bought Phone, that means call forwarding into the system. If you bought Messages, it means the messaging channels stay routed to it. If you bought both, both. We do not ask you to forward a channel you did not buy, and a channel you did not buy is not part of the comparison.

The agent can only beat a setter on the leads it is allowed to answer.

This covers leads routed around a system that is running. Leads you send to a parallel inbox, or a channel you point away from the system while it is on, sit outside the comparison on both sides. Switching the system off altogether is the other case, and section 4 handles it: those days do not count toward the 30.

If a purchased channel is disconnected long enough that the system did not get to answer your inbound leads on it, this condition is not met and the guarantee does not trigger. We will flag it in writing the day we notice, not at the end, so it is never something you find out on day 31.

The 30 day tuning window

The first 30 days are a tuning window. We adjust the agent during that month, and you give us the access to do it: the connected channels, the calendar, the CRM, and your answers when we ask how something should be handled.

An agent nobody is allowed to touch after go-live is the exact failure this offer exists to fix. If access is withdrawn, the tuning window stops and so does the guarantee.

What "we refund the install" means

If, at the end of the 30 day window, the agent has not booked more appointments from your inbound leads than the baseline, and the conditions on this page were met, we refund the install fee in full. The install fee is the one-time setup fee for your package, the line on your invoice that covers the build. It is not the monthly hosting, and it is not the provider costs that run on your own accounts.

Monthly hosting stands for the days you used. The system ran, the messages went out, the infrastructure was on.

Costs that are not ours to refund keep running on your accounts: your AI provider API usage, your messaging and phone charges, and any third party subscriptions. We do not bill you for them and we do not mark them up, so we cannot refund them either.

You keep the system, the configuration, and your data. We are refunding the install because it did not clear the bar, not taking the work back.

What you have to do on your side

The system books appointments into your business. These are the parts only you can supply, and the guarantee assumes them:

  • • Your API key. Supply an AI provider key and keep it funded. If it runs out of credit, the agent stops replying.
  • • An open calendar. Keep at least 10 bookable hours per week visible to the system across the 30 days. The agent cannot book into a full calendar.
  • • Answer the phone. If you bought Phone, take or return the calls the system transfers to you during the business hours you gave us.
  • • Route your leads. Send inbound leads to the channels you bought rather than to a parallel inbox the system cannot see.
  • • Finish onboarding. Complete the strategy call and approve your offer, scripts, and booking rules during the 7 day install. Every day approval waits is a day the install waits.
  • • Leave the agent on. Do not disable, disconnect, or materially rewrite the agent prompt or booking logic without telling us first.

If one of these is not met, we will flag it in writing at the time, not at the end. A condition we never raised during the 30 days is not a condition we get to invoke afterwards.

How to claim

Email support@blackumbrella.app within 14 days of the end of your 30 day window. We reconcile the agent count against the agreed baseline together, in writing, within 5 business days, and the refund goes out within 10 business days of that reconciliation.

The appointment count in your Delta dashboard and the baseline we signed off before go-live are the two records we both work from.

Scope

This guarantee covers the Delta AI Response System engagement it was sold with, one time, for the first 30 day window. It applies whether you bought Messages on its own, Phone on its own, or Messages + Phone together. It does not carry over to renewals, additional locations, or separate engagements unless we put that in writing.

Separately scoped internal applications and custom software builds do not carry the appointment-setting promise; anything we guarantee on those goes in your written scope instead.

Where this page and your service agreement disagree, your signed service agreement governs. Our general Terms of Service continue to apply.
